Terms of Use (EULA)

Please read this End-User License Agreement ("EULA" or "Agreement") carefully before using the ItsMeHere application ("the App," "Licensed Application") operated by ItsMeHere ("we," "us," "our," or "the Developer"). By accessing or using the App, you ("End-User" or "you") agree to be bound by these terms.

1. Acknowledgement

This EULA is concluded between you and ItsMeHere only, and not with Apple Inc. ("Apple"). ItsMeHere, not Apple, is solely responsible for the Licensed Application and its content. This EULA does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions as of the date you accept this Agreement.

For copies of the App obtained through the Google Play Store, this Agreement is between you and ItsMeHere. Google LLC is not a party to this Agreement and has no responsibility for the App or its content.

2. Acceptance of Terms

By creating an account or using any part of the App, you confirm that you are at least 13 years of age and agree to this EULA in full. If you do not agree, you must not use the App.

3. Description of Service

ItsMeHere is a meeting recording, transcription, and AI summarization service. The App allows you to:

• Record audio from meetings using your device microphone.
• Automatically transcribe recordings using AI-powered speech-to-text.
• Generate summaries, key points, and action items using AI.
• Search across your meeting history using semantic search.

4. Account Registration

• You must provide a valid email address and a secure password to create an account.
• You are responsible for maintaining the confidentiality of your credentials.
• You must notify us immediately of any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these terms.

5. License and Scope of Use

Subject to this EULA, ItsMeHere grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The Licensed Application may also be accessed by other accounts associated with you via Family Sharing or volume purchasing.

On Android devices, this license is limited to use on devices you own or control, in accordance with the Google Play Terms of Service.

You agree not to:

• Reverse-engineer, decompile, or otherwise attempt to extract the source code of the App.
• Redistribute, sublicense, or transfer the App to any third party.
• Use the App for any commercial purpose without prior written consent.

6. Acceptable Use

You agree not to use the App to:

• Record conversations without the consent of all parties involved, where required by applicable law.
• Store, transmit, or process any content that is unlawful, harmful, defamatory, or violates third-party rights.
• Attempt to gain unauthorised access to any part of the service or its infrastructure.

7. Recording Consent

You are solely responsible for obtaining all necessary consents from all participants before recording any conversation. Laws regarding recording consent vary by jurisdiction. We accept no liability for recordings made without proper consent.

8. Subscription and Payments

• A free tier is available with limited transcription minutes and AI queries per month.
• Paid plans (Pro, Team) are available via in-app purchase through the Apple App Store or Google Play Store.
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
• Refunds are subject to the policies of the Apple App Store or Google Play Store, as applicable.
• We reserve the right to change pricing with reasonable notice.

9. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, and software — are owned by ItsMeHere and are protected by applicable intellectual property laws.

You retain ownership of all recordings, transcripts, and data you generate through the App. By using the App, you grant us a limited licence to process this data solely to provide the service.

You and ItsMeHere acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, ItsMeHere — not Apple — will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

10. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

11. Maintenance and Support

ItsMeHere is solely responsible for providing maintenance and support services for the Licensed Application, as described in this EULA or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

12. Warranty and Disclaimer

The App is provided on an "as is" and "as available" basis. ItsMeHere is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. AI-generated transcripts and summaries may contain errors.

13. Product Claims

You acknowledge that ItsMeHere, not Apple, is responsible for addressing any claims you or any third party may have relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to:

• Product liability claims.
• Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement.
• Claims arising under consumer protection, privacy, or similar legislation.

14. Limitation of Liability

To the fullest extent permitted by law, ItsMeHere shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

15. Third-Party Services and Terms

The App relies on third-party AI services (including Groq and Anthropic) to deliver transcription and summarization features. We are not responsible for the availability, accuracy, or policies of these third-party services. Their respective terms and privacy policies apply to data processed by them.

When using the App, you must comply with applicable third-party terms of agreement. For example, if you use the App over a mobile data connection, you must not be in violation of your wireless data service agreement.

16. Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country.
• You are not listed on any U.S. Government list of prohibited or restricted parties.

17. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. You may request deletion of your data by contacting us.

18. Changes to This EULA

We reserve the right to modify this EULA at any time. Material changes will be communicated via the App or by email. Continued use of the App after changes take effect constitutes acceptance of the updated terms.

19. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

20. Governing Law

This EULA shall be governed by and construed in accordance with the laws of India. Any disputes shall be resolved in the courts of Nagpur, Maharashtra, India.
